PawM8 Terms of Service
Effective date: April 26, 2026
These Terms of Service (the “Terms”) are a legal agreement between you and Idekini, a company registered in the Netherlands at Van Houtenstraat 60, 7331 SZ Apeldoorn (KVK 98732951, VAT NL005349336B59) — in these Terms, “we”, “us”, or “PawM8” — governing your use of the PawM8 mobile application and related services (the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Community Guidelines. If you don’t agree, don’t use the Service.
These Terms apply to users worldwide, with specific provisions for EU/EEA, United Kingdom, and Turkey consumers in section 13.
1. Eligibility
- You must be 18 or older.
- You must have the legal capacity to enter into a binding contract in your jurisdiction.
- You must not be barred from using the Service under applicable law or by a prior termination of your PawM8 account.
- You must not be a registered sex offender of any kind.
2. Your account
- You’re responsible for keeping your account credentials secure.
- You may not share your account or let anyone else use it.
- You must provide accurate profile information and update it when it changes.
- You’re responsible for all activity that happens under your account.
3. Acceptable use
You agree not to, and not to let anyone else:
- Impersonate another person or misrepresent your identity or pet.
- Harass, threaten, stalk, defame, or discriminate against any user.
- Post or transmit content that is sexually explicit, violent, hateful, or promotes illegal activity.
- Post content depicting or promoting animal abuse, neglect, or cruelty.
- Use the Service to sell, advertise, or solicit commercial goods or services (including breeding or sale of animals) without our prior written consent.
- Attempt to circumvent moderation systems, blocks, bans, or suspensions.
- Reverse engineer, scrape, or probe the Service, or attempt to extract data from other users’ accounts.
- Upload malware, viruses, or any code intended to damage or disrupt the Service.
- Use bots, scripts, or automated means to access or interact with the Service.
We may suspend or terminate your account for violating these rules. For serious violations we may act without prior notice. For other violations, we’ll give you reasonable notice and an opportunity to respond, except where giving notice would create a safety risk or be impractical.
4. Content you post
You retain ownership of the photos, text, voice notes, and other content you upload. By uploading, you grant PawM8 a worldwide, non-exclusive, royalty-free, sublicensable licence to host, display, reproduce, modify (for technical purposes such as resizing or thumbnailing), distribute, and transmit your content solely as necessary to operate, improve, and secure the Service.
You represent and warrant that you own the content or have the rights to upload it, and that the content does not violate any third party’s rights or applicable law.
We may remove content that violates these Terms, our Community Guidelines, or applicable law. Where required by law, we will tell you when we remove your content and why.
5. Moderation and safety
- We use automated systems (image and text moderation) to detect and block content that appears to violate our guidelines.
- We review user reports and take action when appropriate, up to and including permanent bans.
- We do not vet users’ identities or backgrounds. Other users may misrepresent who they are. Meet in public places, tell someone where you’re going, and use your judgment.
- Nothing we do guarantees safety. Meeting people through PawM8 is at your own risk.
6. In-app purchases and subscriptions
PawM8 may offer optional paid features (e.g. PawM8 Gold subscription, Super Paws). Purchases are processed by Apple, Inc. through the App Store and are subject to Apple’s terms and conditions in addition to these Terms.
- Subscriptions auto-renew until cancelled.
- Manage or cancel subscriptions in your Apple ID settings — we cannot cancel them on your behalf.
- Refunds are governed by Apple’s refund policy. Where mandatory consumer protection law in your jurisdiction grants you statutory refund or withdrawal rights (see section 13), those rights apply in addition.
7. Termination
- You may delete your account at any time through Settings → Account → Delete Account. Deletion takes effect immediately and cannot be reversed — see the Privacy Policy for what happens to your data.
- We may suspend or terminate your account if you violate these Terms, harm other users, abuse the Service, or use it unlawfully. Where reasonable and not contrary to safety or legal obligations, we will notify you and explain the reason.
- Sections 4 (Content licence — to the extent already exercised), 8, 9, 10, 11, 12, and 13 survive termination.
8. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, we exclude all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant the conduct, identity, or character of other users, and we do not vet them.
This section does not exclude or limit any liability that cannot be excluded under applicable law — including, in particular, your non-waivable rights as a consumer in the EU/EEA, the United Kingdom, or Turkey (see section 13).
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, loss of data, loss of goodwill, or other intangible losses arising out of or related to your use of — or inability to use — the Service.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of EUR 100 or the amount you paid us in the 12 months before the claim.
Exclusions: the limitations above do not apply to:
- Liability for death or personal injury caused by our negligence
- Liability for fraud or fraudulent misrepresentation
- Liability for gross negligence or wilful misconduct
- Any other liability that cannot lawfully be excluded or limited
10. Indemnification
You agree to indemnify, defend, and hold harmless Idekini, its officers, directors, employees, and agents from any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of:
- Your breach of these Terms
- Your violation of any law
- Your violation of any rights of another person
- Content you upload to the Service
This obligation applies only to the extent permitted by law in your jurisdiction; it does not apply to claims arising from our gross negligence or wilful misconduct.
11. Changes to these Terms
We may update these Terms. Material changes will be announced in the app and by email at least 30 days before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms. If you don’t accept the changes, you can delete your account before the effective date.
12. Governing law and dispute resolution
These Terms are governed by the laws of the Netherlands, excluding its conflict-of-laws principles and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Disputes will be brought to the competent courts of Amsterdam, the Netherlands, except as provided in section 13 for consumer disputes.
You agree first to attempt to resolve any dispute informally by emailing legal@pawm8.com with the subject “Dispute notice”. If we can’t resolve the dispute within 60 days, either of us may bring the dispute to court.
13. Mandatory consumer rights by jurisdiction
Where you use the Service as a consumer (a natural person acting outside the scope of a trade, business, craft, or profession), the following rights apply in addition to anything else in these Terms, and any provision in these Terms that conflicts with these rights does not apply to you.
13.1 EU and EEA consumers
- The choice of Dutch law does not deprive you of the protection granted by mandatory provisions of the law of your country of residence (Rome I Regulation, Art 6).
- You can bring proceedings in the courts of your country of residence (Brussels I Regulation, Art 18).
- For paid digital content / digital subscriptions, you have statutory withdrawal rights under Directive 2011/83/EU (Consumer Rights Directive). For App Store-mediated purchases, withdrawal is exercised through Apple’s refund process.
- The European Commission’s Online Dispute Resolution (ODR) platform is available at https://ec.europa.eu/consumers/odr — though we encourage contacting us directly first.
13.2 United Kingdom consumers
- The choice of Dutch law does not deprive you of the protection of the Consumer Rights Act 2015 and other mandatory UK consumer- protection law.
- You can bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland (as appropriate).
13.3 Turkish consumers
- These Terms do not deprive you of any non-waivable right under the Law on the Protection of Consumers (Tüketicinin Korunması Hakkında Kanun, Law No. 6502) or related regulations.
- You can apply to Tüketici Hakem Heyeti (Consumer Arbitration Committee) or to the Tüketici Mahkemesi (Consumer Court) for disputes within the financial thresholds set by Turkish law.
14. Miscellaneous
- Entire agreement. These Terms (together with the Privacy Policy and Community Guidelines) form the entire agreement between you and PawM8 about the Service and replace any earlier agreement.
- Severability. If any provision is held unenforceable, the rest continues in effect.
- No waiver. Our failure to enforce a right does not waive it.
- Assignment. You may not assign these Terms. We may assign them to an affiliate or successor in connection with a corporate transaction (see Privacy Policy section 4.4).
- Notices to us. Send legal notices to legal@pawm8.com and by post to Idekini, Van Houtenstraat 60, 7331 SZ Apeldoorn.
- Notices to you. We will send notices to the email address on your account.
